The High Constitutional Court (HCC) has declared Law No. 2026-004, the amended budget law (LFR) for 2026, compliant with the Constitution. In its decision No. 12-HCC/D3 issued on July 15, 2026, the constitutional court rejected any legal obstacles to the law's promulgation, finding that it meets requirements set by the Constitution and the organic law governing budget laws. A key point examined was the early submission of the amended budget law. Typically, such legislation is presented during the second half of the year, except in cases of necessity or urgency. The HCC determined that circumstances cited by the Government justified this exception. The court noted that the country faces a succession of exceptional factors that significantly altered assumptions made when drafting the initial budget law. These include the Refoundation initiated following the regime change in October 2025, consequences of recent climate events across Madagascar, economic repercussions of the Middle East crisis, and expected effects from the end of AGOA and USAID programs. According to the High Court, these new developments require substantial revision of budget priorities to align public finances with a revised growth target of 3.8%. This revision includes tax and customs policy reform, new management of state workforce including salaries and pension funds, and rebalancing of public treasury operations. Judges also verified that the bill included all documents required by the organic law on budget laws, including a report on economic and budget developments, a performance document, budget annexes, and a medium-term framework. The High Court further confirmed compliance with the fundamental principle of budget balance. It found that revenues and expenditures provided by the amended budget law both total 30,731,751,721 thousand ariary, ensuring the financial balance required by current legislation. After its analysis, the HCC concludes that no provision of the 2026 amended budget law contradicts the Constitution. The decision definitively validates the text, which can now be promulgated and implemented to support the state's new budget priorities for the second half of 2026.
