The authorized entity will have free access to existing infrastructure. The bill establishing direct importation of petroleum products by the Malagasy State through an authorized entity is already raising questions in economic circles. This is because the future entity authorized by the State will benefit from a number of preferential treatments compared to other operators. Exemption. Some analysts believe the State must demonstrate transparency and objectivity in designating the authorized entity, as well as clarify the system's consequences for other operators. Article 9 indeed provides that, for its distribution activities, the authorized entity will be exempt from the obligation to cover eight petroleum districts, as currently required by existing legislation. This provision is justified by the "innovative and recent" nature of the national coverage principle, as well as by the mission entrusted to this structure to ensure equitable access to petroleum products for the population. In practice, this exemption means the public entity will not immediately be subject to the same regulatory constraints as other sector distributors. The legislator clearly considers this flexibility necessary to enable the new structure to effectively fulfill its mission. Set of Prerogatives. The bill goes further with Article 11, which guarantees the authorized entity free and non-discriminatory access to essential sector infrastructure, particularly import depots and terminals operated by logistics companies and hydrocarbon license holders. This principle of access to strategic infrastructure follows a well-known logic in several economic sectors: preventing indispensable facilities from becoming an obstacle to economic activity. In this sense, the provision pursues an objective of market fluidity and supply security. However, the combination of these two articles grants the future public entity a set of prerogatives that distinguish it from other market operators. Between reduced regulatory obligations and facilitated infrastructure access, this structure will benefit from a particularly favorable legal environment, which risks frustrating other operators.
