Forgery and use of forged documents. Beyond civil jurisdiction, a land dispute involving nearly 180 hectares in Itasy, opposing two former spouses, passed through the Anti-Corruption Unit (PAC). The ex-husband filed a complaint for forgery and use of forged documents with the PAC against his former wife and their daughter, accusing them of selling land—different from the one in Itasy—without his consent. However, the person who acquired the land located in Andohatapenaka, which was part of the ex-wife's personal share, was none other than their daughter. The ex-husband's hidden objective was to have the parties criminally convicted, but they were ultimately acquitted by the PAC. He was also dismissed by civil court in his request to annul the sale concluded between his ex-wife and their daughter. Statute of limitations. All this reflects judicial harassment against the ex-wife, whose request to annul the sale deed between her ex-husband and his second wife was barred by the statute of limitations for failure to observe procedural deadlines. The Supreme Court based this decision on the law relating to marriage and matrimonial regimes in its ruling of April 21, 2022, whereas the divorce between the parties was pronounced on June 19, 2006. In short, the one-year deadline provided by the law in question no longer applies to them. Moreover, the sale concluded on August 21, 2008 is subsequent to the dissolution of the joint property between the two ex-spouses. In other words, at a time when they were no longer married, and therefore not governed by the law relating to marriage and matrimonial regimes, which is, in their case, time-barred. As the name of the disputed land, "Artiguere 1200," indicates, we are witnessing a veritable legal war. The next episode will take place tomorrow, the date set for the Supreme Court's deliberation, which was the subject of a request for reconsideration by the ex-wife, who was caught off guard. It remains to be seen whether August 13 will bring happiness or misfortune to one or the other party to the case.
