Four-Phase State of Emergency
First established on April 7, 2026 for 15 days, the energy emergency state was renewed on July 1, then extended twice on July 17 and August 7. A fourth 15-day period of energy emergency has now been declared across the entire national territory to secure fuel supplies, ensure continuity of essential services, and allow Jirama to build diesel reserves for its power plants. The decree extending the energy emergency was issued three days before the 35th anniversary of the August 10, 1991 massacre commemoration, during the "Hery Velona" march toward Iavoloha palace, which the Admiral had failed to prevent despite the emergency adoption of law 91-011 of July 18, 1991 on states of exception. Three and a half decades later, this law restricting public freedoms has not been repealed or reformed. It grants the PRRM "special powers whose scope and duration are fixed by organic law." It remains to be seen whether the National Assembly will be convened in extraordinary session, unless the president of the Refoundation takes the initiative himself, as upon proclamation of the energy emergency, he can legislate by ordinance on matters within the law's domain. In essence, he would be both Executive and Legislative, even though the still-valid Constitution guarantees in its preamble "the separation and balance of powers exercised through democratic procedures." The state of exception also allows the PRRM to "order home searches day and night of persons whose activities would be dangerous to public order or state security." Finally, the energy emergency gives him power to requisition resources, in anticipation of the arrival of 65,000 cubic meters of diesel imported by the entity authorized by the Refoundation regime.
