The High Constitutional Court (HCC) has validated a law transferring land registered under foreign names during the colonial period to the State. In its decision issued on August 3, the constitutional court ruled that the text contains no provisions contrary to the Constitution. Submitted to the HCC by the President of Refoundation before its enactment, the law aims to legally regulate the automatic transfer of these lands to the State. According to the reasoning in the decision, this measure is part of efforts to complete the land decolonization process, strengthen State control over strategically important lands, and restore the rights of the Malagasy people over this land heritage. The HCC notes, however, that the law provides several exceptions. Land belonging to foreign diplomatic and consular representations is not affected. Also excluded are lands already transferred to Malagasy nationals and those belonging to foreign individuals who have acquired Malagasy nationality, provided their naturalization is properly registered. The text also provides a regularization procedure for good-faith occupants and opens the possibility of filing a civil suit in case of dispute or litigation. Ihariana Sarobidy
